1. Acceptance of Terms

By accessing or using the Smart Phone Deals website (smartphonedeals.com.au) or our telco comparison service, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. About Our Service

Smart Phone Deals is an independent third-party comparison and referral service. We help Australian residents compare mobile phone plans, NBN home internet, and TV & entertainment bundles offered by leading Australian providers. We do not provide telecommunications services ourselves and are not affiliated with, or endorsed by, any carrier.

Our service is free to consumers. We may receive referral compensation from a provider when you sign up through our recommendation. This is disclosed in line with the Australian Competition and Consumer Commission (ACCC) guidance on commercial and affiliate relationships, and does not affect the price you pay.

3. Accuracy of Information

While we make every effort to keep plan information accurate and up to date, we do not guarantee that all pricing, availability, speeds, or terms shown on our website are current or error-free. Providers may change their plans, prices, and terms at any time without prior notice to us. NBN speeds and availability also vary by address and network conditions.

You should always verify current pricing, terms, and availability directly with the provider before making a purchasing decision. Smart Phone Deals is not responsible for discrepancies between information on our site and what a provider ultimately offers.

Prices displayed on our website include GST at the current rate of 10% where applicable, consistent with the single-price display requirements under section 48 of the Australian Consumer Law.

4. Consumer Guarantees & Cooling-Off

Nothing in these terms excludes, restricts, or modifies the consumer guarantees that apply under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Cancellation and cooling-off rights for any plan you take up are governed by your chosen provider's terms and the Telecommunications Consumer Protections (TCP) Code. In some cases — for example, an unsolicited consumer agreement under the Australian Consumer Law — a statutory cooling-off period (generally 10 business days) may apply. Please confirm your cancellation rights directly with your chosen provider.

5. No Provider Endorsement

Mention of any telecommunications provider, service, or product on our website does not constitute an endorsement or recommendation by Smart Phone Deals. We present comparison information for informational purposes only. All provider names and trademarks are the property of their respective owners.

6. User Responsibilities

When using our website or calling our service, you agree to:

Provide accurate information about your location and service needs
Use our service only for lawful personal purposes
Not attempt to misuse, hack, or interfere with our website or systems
Not reproduce or republish our content without prior written permission
Not use our service if you are under 18 years of age

7. Call Recording

Calls to our service number (1800 945 107) may be recorded for quality assurance, training, and compliance purposes. You will be informed at the start of the call before recording begins. We handle call recordings in accordance with our Privacy Policy, the Privacy Act 1988, and applicable Australian surveillance and interception laws.

All content on the Smart Phone Deals website — including text, graphics, logos, and design — is the property of Smart Phone Deals or its content licensors and is protected by the Copyright Act 1968 (Cth). 9. Limitation of Liability

To the maximum extent permitted by applicable Australian law, and subject to the consumer guarantees under the Australian Consumer Law, Smart Phone Deals shall not be liable for any indirect, incidental, special, or consequential loss arising from:

Your use of or reliance on our comparison information
Service disruptions, errors, or inaccuracies on our website
Any telecommunications contract entered into with a third-party provider
Disputes between you and your chosen service provider

Nothing in these terms limits or excludes any liability that cannot be limited or excluded under Australian law, including your rights under the Australian Consumer Law. Where liability can be limited, our total liability to you for any other claim shall not exceed $100 AUD.

10. Third-Party Links & Providers

Our website may contain links to third-party provider websites. We have no control over those sites and are not responsible for their content, privacy practices, or terms. Visiting third-party sites is at your own risk.

11. Complaints

If you have a complaint about our service, please contact us at complaints@smartphonedeals.com.au or call 1800 945 107. We aim to resolve all complaints within 14 business days. If your complaint relates to a telecommunications provider, you may also contact the Telecommunications Industry Ombudsman (TIO) at tio.com.au. Privacy matters can be raised with the OAIC at oaic.gov.au.

12. Governing Law & Jurisdiction

These Terms of Use are governed by the laws of Australia. Any disputes shall be subject to the jurisdiction of the Australian courts. Your rights under the Australian Consumer Law apply in addition to these terms.

13. Changes to These Terms

We reserve the right to update these Terms of Use at any time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of our service after changes are posted constitutes your acceptance of the revised terms.
